Recently, another homeowner said they were the victim of a fraudulent contractor and lost a bunch of money. This has made me want to help homeowners protect themselves and contractors to know requirements.
In Mississippi, residential construction/roofing projects $10,000 or more require a Mississippi State Board of Contractors license which requires passing some tests to make sure the qualified contractor does quality work for the residence of Mississippi. This is NOT the same as a standard business license. Unfortunately, many homeowners are unaware that hiring an unlicensed contractor can create SERIOUS issues.
Under Mississippi Code Title 73, Chapter 59, any person performing residential remodeling or roofing valued at $10,000 or more must be licensed by the Mississippi State Board of Contractors (MSBOC).
Unlicensed contracting above this threshold results in severe legal and financial penalties.
•Can be fined not less than $100 and not more than $5,000 and/or
•Can be imprisoned for not less than (30) days nor more than (60) days• Possible misdemeanor charges• Cease-and-desist orders (stop work in middle of doing project)• Difficulty enforcing contracts in court. Unlicensed contractor may not bring any action, either at law or in equity, to enforce any sales contract. Homeowner does not have to pay you and there’s nothing you can do about it.
• Liability issues involving insurance and workmanship claims
Most importantly, homeowners can end up exposed if something goes wrong during or after the project.
The illegal contractors may not be around in the future to give any type of WARRANTY.
