Most Florida residents are not aware of the new State requirements that have been set in place when dealing with septic systems.
Since July 1, 2023, HB 1379 requires new OSTDS on lots one acre or less to include enhanced nutrient reduction OSTDS (ENR-OSTDS)(aerobic systems) in BMAP areas, Reasonable Assurance Plan (RAP) areas, and Pollution Reduction Plan (PRP) areas. Starting on January 1, 2024, additional requirements for ENR-OSTDS (aerobic systems) for new systems on all lot sizes will come into effect but will apply only to lots in the Indian River Lagoon Protection Area (portions of Brevard, Indian River, St. Lucie, and Volusia Counties). Within that area, applications that are received by the county health department (CHD) on or after January 1, 2024, or applications received before January 1, 2024, but incomplete (except the site evaluation) will be subject to the new requirements. For all other parts of the state, HB 1379 implementation will continue as it has since July 1, 2023.
IN SHORT, if you own a lot that is one acre or less that falls within the boundries of the BMAP, and you are needing a new septic system because there is no city sewage available, you will be required to install an aerobic system. When you apply for your septic permit it will indicate whether you will need this type of septic system or not. If your property is in the Indian River Lagoon Protection area there are different requirements.
