SEPTIC PIPE SABOTAGE: A Town of Newburgh jury has convicted 74-year-old Nicholas Gemma of criminal mischief after prosecutors say he repeatedly cut his neighbor’s septic pipe during an ongoing dispute.
According to the Orange County District Attorney’s Office, surveillance video captured Gemma entering the victim’s property and cutting the pipe with a saw in December 2025. Prosecutors say the damage left the homeowner unable to use his toilet, sink or shower and marked at least the third time Gemma had cut the pipe.
The DA’s office says Gemma claimed the pipe created an odor, but investigators found no violations of state or county sanitary codes.
“Neighbor disputes need to be resolved between the parties in a civil fashion and should not devolve into vigilante criminal behavior,” District Attorney David Hoovler said.
Gemma is scheduled to be sentenced Sept. 15. Prosecutors say he could face anything from probation to up to one year in the Orange County Jail, along with possible restitution, community service and other court-ordered conditions.
