I am happy to see that justice has finally been served on Kevin Cheek, former owner of Texas to Paradise Pools in Corsicana, TX. I feel for the victims who have crossed paths with Kevin Cheek from 2020 forward and have been victimized by his greed and manipulative power. Unfortunately, his Texas to Paradise Pool victims weren't able to convince legal authorities to serve justice on Kevin Cheek when he stole nearly one million dollars from unsuspecting customers who trusted him to meet his obligations. Kevin Cheek has had an additional FOUR years to victimize and steal from more people. Kevin Cheek is a thief and it was just a matter of time before his luck of avoiding legal consequences caught up with him.

This is an excellent example of local authorities and law enforcement working together to bring some justice to corrupt general contractors. Kevin Cheek is a thief and corrupt. He stole 100s of thousands of dollars, but our group of victims has not convinced local law enforcement yet to take action.

Intent to deceive. That is this week's lesson, boys and girls. I established confirmation that Kevin Cheek and his company Texas to Paradise Pools & Spa, purposely and knowingly deceived me as a consumer from the day I signed a contract with him to build my pool.

Day 1 - My wife and I sat down at my kitchen table with Kevin Cheek and Corey Wurmlinger to review their proposed design plans for our pool. After many questions and a few tweaks, we signed a contract, and I handed Kevin Cheek a $5000 check as a down payment. The initial check was to cover pool design & plans, licensing & permits, and start coordinating the initial steps to start building. A couple of weeks later, I received a call from Kevin Cheek telling me my plans had been approved by the city and that my pool did not require a permit because my new pool was replacing an existing pool. Deception #1

Day 212 - Some of Kevin Cheek's other clients report that he never obtained permits from their city permitting offices to build their pool. Curious, I called my local licensing office and was told a permit was never issued for my pool. I cautiously proceeded to explain my situation regarding a pool replacement, knowing that with Kevin Cheek AWOL on my project, I could possibly be on the hook for his deception. I received very vague, incomplete answers to my questions about the requirements for existing pools from the clerk.

Day 730 - I contracted with a new pool company to complete my pool that Kevin Cheek abandoned. The contractor and I questioned the validity of Kevin Cheek's initial information regarding a permit. I again called the local licensing office and explained my situation, only now I am moving forward with a different contractor 2 years later. This go round, I received more definitive answers, and confirmation that a replacement pool or not, a permit was necessary, and inspections were required. I asked if there was any record that plans had been submitted for my pool and if any waivers or a paper trail indicated a permit was optional. The clerk went as far back as 2020 and found no indication that an application or plans had ever been submitted. Deception #2

The lesson learned when working with a general contractor is always to confirm they are doing what they say they did, and DO NOT take their word for it. It is insane that you pay them to do the right thing, but then you, the consumer, have to follow up behind them to verify they did it. I went out of my way to select a local pool contractor with roots in my small town, thinking there would be higher trust and accountability. When my wife and I sat at my kitchen table with Kevin Cheek and Corey Wurmlinger, I trusted they would do the right thing. I was wrong, and I made a mistake thinking Texas to Paradise Pools & Spa was less corrupt than a pool contractor from the big city.

Two years into my pool replacement project, the emotions of frustration, anger, and disappointment are just as raw today as when Kevin Cheek and Texas to Paradise Pool & Spa tried to get me to write another check for work they were never going to complete.

My story is not nearly as monetarily damaging as some Kevin Cheek clients have experienced, but the emotions and impact Kevin Cheek has had on all our lives are weighted equally. He stole money from us. He ruined homes. Kevin Cheek is a criminal and has gotten away with his crime so far.

Kevin Cheek is not nearly as unique or as clever as he thought or possibly still thinks he is. There are dozens, if not more, opportunist pool contractors in the Dallas - Fort Worth area that did exactly what Kevin did. They saw an opportunity to capitalize on making a lot of money really fast but, unfortunately, did not have the mental capacity to understand basic business planning and strategy. Kevin Cheek, if you are reading this, doubtful that you are, you can not take payments from one customer to complete another customer's project. That is a PONZI Scheme, and it is not sustainable. The moment one domino falls from your brilliant plan, the dream is over.

What I describe above is precisely what Kevin Cheek attempted to pull off with his business. I 100% believe in Kevin's mind, he dreamed of being the top pool builder in DFW, Texas, or maybe even the US. However, when you associate yourself with incompetent business partners who are scheming opportunists themselves; when you have ZERO business education, ZERO financial security, and REWARD yourself with big expensive purchases and Mexican vacations; you will fail. And in your wake, you leave victims, and the trail of victims is not only customers, but employees, sub-contractors, suppliers, friends, and even family.

Kevin Cheek will try to convince you he is the actual victim. He will attempt to tell you that COVID, supply chain issues, the weather, corrupt business partners, expanding his business too fast, the death of a close friend, a DWI, and divorce contributed to his failure. I challenge that vein of reasoning because those are all excuses Kevin tells himself to justify his actions. True that list of business-crushing variables could bring down even the healthiest of businesses. However, when you start a business without a solid foundation in the first place, you do not stand a chance.

I'll have you swimming in 90 days, Kevin promised - nearly two years later, 10s of thousands of dollars in the hole; Kevin Cheek now blocks his calls and texts from me. Like hundreds of other low-life contractor scam artists, Kevin Cheek quietly slips into the shadows and waits things out until we all forget.
