SCOTUS will be a hot topic over the next month. You'll hear A LOT about the supposed "balance" of the court being shifted. Remember this, there is no ideological balance on the Supreme Court, no liberal or conservative, left or right. The Supreme Court is meant to do one thing, and ONLY one thing, and that is to decide constitutionality or unconstitutionality.
Constitutionality has no ideology, not left or right, it simply is or isn't. We have been sold a bill of goods on the Supreme Court for decades, driven by those whose goal was to "reinterpret" the Constitution rather than be constrained by its limits. Ideas and policies that could not be passed legislatively and could not make it through the Constitutional Amendment and ratification process were advanced by activist judges through linguistic gymnastics in Constitutional interpretation.
Not all judicial activism comes from the left, but the left has certainly mastered the art. Activism and artful interpretation has no place in the Supreme Court, or any court for that matter. Statutory law and activist legal precedent DO NOT supercede Constitutional Law. If the supposed balance of the court shifts towards Constitutional originalism and textualism, it is NOT an ideological shift. It is a return to the proper role of the court. Ideology and policy are political NOT judicial. As far as the court is concerned, the only issue is whether that ideology or policy is Constitutional or not. Period.
Don't be fooled by political labels applied to SCOTUS Justices. The only label that matters is whether they are Constitutionalist or Activist, whether they APPLY Constitutional Law or try to INTERPRET it to fit an agenda. The House of Representatives represents the People, the Senate represents the States, the President represents both to the world. The Supreme Court represents the CONSTITUTION and nothing more. They hold elected representatives at all levels of government to the limits imposed upon them by the Constitution that swore an oath to protect and defend.
As we wade through the rhetoric and political dogma over the next month, keep the proper role of the Court, and Justices who serve on it, firmly in mind. Separate from the ideological propaganda that will be heaped upon us. Restore The Court to its proper role.
